The new Title IX rules are now in effect (click here for a summary of the 2024 Title IX changes), but federal litigation focuses on the rules’ explicit protection of LGBTQ+ students.

LGBTQ+ Student Protections in Washington State

In our state, “…LGBTQ+ students in Washington schools continue to have a longstanding right to equally access their education and a school environment free from discrimination and harassment.” (Sarah Albertson, OSPI, Managing Attorney, Equity and Civil Rights)

OSPI’s webpage on Discrimination and Sexual Harassment delineates school districts’ obligations under state and federal law, and lists protected groups sharing common characteristics, including gender identity and gender expression. The OSPI webpage on Sex Equity in Athletics provides clarity on our state’s commitment to support all students’ participation in K-12 sports activities.
